Bus Passengers are Entitled to No-Fault Benefits
Thankfully, Michigan’s No-Fault Act protects bus passengers who are injured in an accident. In fact, there does not seem to be any difference between injured passengers on a bus when compared to an injured passenger in a car. Either way, the injured party must look to his/her own insurer first. If that person is uninsured, the party must look to the insurance of the owner of the vehicle. Then, that party must look to the insurer of a domiciled family member. Only when there is no one else to sue for PIP benefits does it become appropriate to sue the bus’s insurer for PIP benefits. Of course, should you sustain a catastrophic injury, and you want to collect non-economic damages for pain and suffering, one other party may be available to sue.
In normal car accidents, you are usually limited to suing the negligent driver of the other vehicle. That is not to say that one would not have a right to sue the driver of the vehicle he/she was a passenger in where there is a normal car accident; but it is likely that one would be suing a family member or friend in such a scenario.
