Getting an Eviction is a Three-Step Process

Evicting a tenant is a three-step process under the laws of the state of Michigan. First, a landlord must serve a tenant with a 7-day demand for possession or a 30-day notice to quit. Once the demand for possession or notice to quit has been served, and the time period has expired, a summons and complaint may be filed with the court. The landlord is the plaintiff in these cases, and the lease agreement (if there is one in writing) and a copy of the demand for possession or notice to quit must be attached to the complaint when filed with the court. These documents get filed in the appropriate district court. These documents must also be served upon the tenant.

Landlords may seek an order to evict, a money judgment or both. Obtaining a money judgment requires personal service of these materials on the tenant(s). Once the district court has filed these documents, a hearing date will be set. Tenants have the ability to request a trial. It is imperative on all parties involved to prepare for these hearings as if a trial will be conducted. That means that receipts, pictures and witnesses should be brought to court. If a judge orders the tenant(s) to move out, he/she will typically give the tenant ten days to move. Depending on the circumstances, the judge may give additional time if it is reasonable. If the tenant still does not do what a judge has ordered, an order to evict will be issued. At this point, a landlord must contact a bailiff to remove the tenant(s) and personal property from the premises.
